How to Appeal a Social Security Repayment Request for December Benefits

hey marc! Apr 12, 2023

I have a client that is being told to repay Dec 2022 Social Security payment. He did not work in Dec 2022 (the month he began SS). The SSA 561 doesn’t seem like the right form. But I can’t find anything else. How can he apply for this appeal?

If your client is being told to repay their December 2022 Social Security payment, even though they didn’t work that month, here’s how they can appeal the decision:

  1. Form SSA-561 – Request for Reconsideration:

    • Correct Form for Appeal: The SSA-561 is indeed the correct form if your client needs to file a formal Request for Reconsideration. This form is used to appeal decisions made by the Social Security Administration (SSA) regarding benefits.
  2. Consider Contacting the Local SSA Office First:

    • Avoiding Unnecessary Paperwork: Before filing the SSA-561, it might be beneficial for your client to contact their local SSA office directly. By explaining that they were under the monthly earnings limit for December, they might be able to resolve the issue without needing to file the form.

In summary, while the SSA-561 form is appropriate for filing an appeal, reaching out to the local SSA office first could potentially resolve the issue more quickly and easily.
