How to File for Disability Benefits if You Can No Longer Work

full retirement age (fra) hey marc! primary insurance amount (pia) Jan 04, 2023

I have a married female client Annette born 6/1958, who is undergoing 8 week spinal treatment and then possible back surgery.  The doctors are saying this has a 50% chance of success.  If she cannot work due to this pain, what is the best approach or process for filing for Disability?  Is getting an attorney needed or is it a matter of filling out the correct form, etc?  Btw, she was looking at retirement and filing FRA with PIA $2,900 current.

If Annette is unable to work and is expected to earn less than $1,470 per month due to her spinal condition, she may be eligible for Social Security Disability benefits. The primary advantage of disability benefits over early retirement is that disability benefits are not reduced for age, meaning Annette could receive her full Primary Insurance Amount (PIA) of $2,900.

The process of applying for disability can be initiated online through the Social Security Administration (SSA) website. Annette will need to provide detailed information about her medical condition, including the names, addresses, and contact information for any doctors, hospitals, or clinics that have treated her. This information is crucial as it supports her claim for disability.

Hiring an attorney is not necessary for the initial application. Many individuals successfully file on their own by carefully completing the application and providing thorough medical documentation. However, if Annette feels overwhelmed or if her initial application is denied, she may want to consider consulting with a Social Security Disability attorney to assist with the appeals process.

If she prefers more personalized assistance, Annette can also call the SSA at their toll-free number (800-772-1213) to schedule an appointment to file her application in person or over the phone.
